Withdrawal By Government Of Statutory Instruments

EDM number 271 in 2001-02, proposed by Stephen O'Brien on 18/10/2001.

That this House notes that Her Majesty's Government in Standing Committee on 16th October was driven to withdraw a draft statutory instrument, namely the Contracting Out of Functions (Tribunal Staff) Order 2001, having heard the arguments of the Shadow Attorney General, the honourable Member for Stone, with the support of the Liberal Democrats that on its face the order appeared to be ultra vires; that the committee was therefore adjourned; and calls upon Her Majesty's Government to re-assess the order and to take all necessary steps to ensure its legality before reintroducing the proposed legislation.
