That this House deeply regrets the decision of the Court of Appeal on 5th November in C & G Homes Limited v Secretary of State for Health and the threat which it creates for the homes of eight former psychiatric patients; urges C & G Homes Limited to permit the residents to remain in their homes; urges Bath District Health Authority to urgently make all arrangements necessary to maintain the rights of the residents; and calls on the Secretary of State for Health to give urgent guidance to all community care agencies to ensure that accommodation provided as part of the community care programme offers clear and guaranteed rights of occupation to its residents free from discrimination and the segregation this encourages.
