That this House notes that in public family law cases FB11C00396 and FB1100376C in the Birmingham Courts, there is no transcript of the judgment on the file; recognises that the absence of a transcript of a judgment prevents parties from making a detailed application for permission to appeal; further notes that in the case of FB1100376C the hon. Member for Birmingham, Yardley had been told by the court call centre that a copy of the judgment had been sent out; further recognises that in both cases the parties are now out of time merely because of the absence of a transcript of the judgment; believes that these cases are not unique and are merely two examples of a systemic problem; further notes that this undermines the accountability of the legal system and the rule of law by acting to deter and prevent proper appeals where unlawful decisions have been made; and calls for this matter to be given proper consideration by the judiciary, the Government and appropriate parliamentary committees.
