International Criminal Court And The Un Security Council

That this House notes the forthcoming meeting of the Assembly of States Parties to the International Criminal Court (ICC) in May 2010 in Kampala to reach an international agreement on the definition of the crime of aggression and the jurisdiction of the ICC over this crime; further notes the division between those states that wish ICC jurisdiction to be subject to Security Council approval and those that believe the ICC should be able to investigate crimes of aggression without Security Council authorisation; reaffirms its support for the Security Council's primary role in the maintenance of international peace and security, as set out in the UN charter; recalls, however, that the veto power of the permanent members often prevents the Security Council from agreeing on action; and therefore urges the UK Government to press for the adoption of the so-called Red Light measure which would allow the ICC to exercise its jurisdiction over the crime of aggression if the Security Council was unable to make a decision, within an agreed time limit, on an application by the ICC to investigate an allegation of this crime.
