That this House notes that in part of her reply to a Question from the hon. Member for Blaenau Gwent seeking to ascertain what assessment had been made of paragraphs 34 and 35 of the adjudication of the High Court on 17 October 2008 in respect of a case brought by Help the Aged and Friends of the Earth on enforcement of the Warm Homes and Energy Conservation Act 2000, the Parliamentary Under Secretary of State, the right hon. Member for Lewisham, Deptford, stated that `provisions like that section are commonly included in Bills, and therefore in Acts of Parliament, without any intention that they should have a substantive legal effect,' 3 February 2009, Official Report, column 1002W; believes that if Ministers take such a view on Bills that have passed through this House under scrutiny from hon. Members and peers in another place, then it would make a mockery of all Acts of Parliament; and calls on the Secretary of State for Energy and Climate Change, in respect of the Warm Homes and Energy Conservation Act 2000 and the Leader of the House more generally, to explain the purpose of inclusion of clauses in Acts of Parliament that Ministers can then ignore with impunity.
