Conviction Of John Torney
EDM number 889 in 2006-07, proposed by Mark Durkan on 19/02/2007.
That this House notes the concerns of the respected independent non-governmental organisation British Irish Rights Watch (BIRW) regarding the soundness of the conviction of John Torney, found guilty of murdering his wife and two children in 1994; further notes that Mr Torney maintained his innocence right up until his death in prison in June 2005; recognises that evidence has come to light that was not made available at the trial which BIRW argues casts doubt upon the conviction; further recognises that the Criminal Cases Review Commission (CCRC) has not fully investigated all aspects of this new evidence; is concerned at the lack of progress by the CCRC in complying with the Order of the Divisional Court in the High Court of Justice in Northern Ireland made on 22nd June 2005 directing the CCRC to take all steps necessary to identify a crucial witness; and considers that it is now time for a complete and thorough review of all aspects of the case by the CCRC with a view to its referral to the Court of Appeal.
