Federal Mogul And Turner And Newall
EDM number 468 in 2001-02, proposed by Michael Clapham on 22/11/2001.
That this House is horrified to learn that hundreds and perhaps thousands of former employees of Turner and Newall who are suffering with asbestos-related diseases may not get any compensation because, together with its UK subsidiaries, it has been made the subject of an administration order following the voluntary Chapter 11 bankruptcy of the parent company, Federal Mogul, that was applied for with the express purpose of shielding the group from asbestos-related compensation claims, whilst allowing them to continue trading and making a return for the shareholders when it has been revealed that Turner and Newall are not insured for claims arising from asbestos exposure from 1972 onwards, in spite of the obligation for them to have employers' liability insurance from 1st January 1972; and calls on the Government to institute a full enquiry into the company and to consider legislating for an insurance industry funded compensation scheme to cover injury and disease cases where no insurer can be traced.
