Scottish Stamping

That this House expresses its dismay at the continuing refusal of the management at the Neptune works of Scottish Stamping in Ayr to re-instate four workers, Denis MacIntosh, James Clark, Alexander Whiteside and William Reid, in accordance with a decision of an industrial tribunal in June 1993 which concluded that they had been unfairly dismissed by the company; notes that Scottish Stamping is owned by United Engineering Steels Ltd., formerly a joint venture between British Steel and GKN; notes that the four workers all had long periods of loyal service at Scottish Stamping and collectively had worked for the company for 115 years before their dismissal; expresses its concern at the lack of statutory powers under current legislation to enable industrial tribunals to enforce re-instatement decisions; expresses its concern at the lack of power to award compensation based on actual loss of earnings due to dismissal; expresses its concern at the loss of pension rights, including receipt of early retirement pensions, by the unfairly dismissed employee if not re-instated; asks that the Secretary of State for Employment amends current employment legislation to ensure that decisions taken by industrial tribunals can be implemented; and further asks that awards of compensation for unfair dismissal are based on more realistic criteria.
