Conduct Of The Prime Minister, Secretary Of State For The Environment And Westminster City Council

That this House believes that the Prime Minister and the Secretary of State for the Environment misrepresented the legal status of the District Auditor's decisions; affirms that in his summary of findings and views the District Auditor decided that Westminster City Council acted unlawfully in five separate respects, and found Mr Graham England, Mr Peter Hartley, Mr Paul Hughes, Mr Bill Phillips, Dame Shirley Porter and Councillor David Weeks guilty of wilful misconduct, on the most cogent evidence and only because the District Auditor was sure that he should make these decisions, the legal position is that the findings of unlawfulness and wilful misconduct stand until and unless they are overturned by the courts; and calls on the Prime Minister and the Secretary of State for the Environment to stop trying to misrepresent a perfectly clear legal position.
