Reform Of Privity Of Contract

That this House welcomes the publication of the Consultation Paper on Rights and Duties of Landlords and Tenants which reinforces the Government's commitment to reform the inequitable law of privity of contract for all new leases; notes that the paper seeks views on the agreement reached by the British Retail Consortium and the British Property Federation which introduces better protection for tenants who continue to be caught under the law of privity of contract, and also seeks to amend section 19 of the Landlord and Tenant Act 1972, whereby landlords and tenants can agree terms upon which future assignments may be made; supports the introduction of the Landlord and Tenant (Covenants) Bill which would introduce balanced reform of the law of privity of contract by incorporating the British Retail Consortium and the British Property Federation Agreement; and calls upon the Government to support the Bill which will create fairer leases for all.
