Merger Of St.bartholomews And The Royal London Hospital - Transfer Of Property

That this House is concerned that in the current dispute between the Secretary of State for Health and The Royal Hospital of St. Bartholomew's, the Royal London Hospital and London Chest Hospital National Health Service Trust, the Secretary of State is making proposals which are unlawful; notes that paragraph 3(2) of the Statutory Instrument 1994 No. 307 setting up the Trust provides inter alia for the merger Trust 'to own and manage hospital accommodation and services provided at the Royal Hospital of St. Bartholomew's, West Smithfield, London EC1A'; notes that the Secretary of State is refusing to transfer the freehold of St.Bartholomew's at Smithfield to the Trust and instead is offering only to give the Trust a five year lease on the Smithfield site; notes that lawyers have said that this proposal is unlawful; and calls on the Secretary of State to hand over the freehold and uphold the rule of law rather than prepare to privatise the Smithfield site.
