Death Of Ashley Gardiner
EDM number 778 in 1989-90, proposed by David Alton on 22/03/1990.
That this House deeply regrets the death of Ashley Gardiner, who died following a drink-driving incident when her mother, Mrs Donna Gardiner who was 34 weeks pregnant with Ashley, was knocked down on a pedestrian crossing; deplores the Crown Prosecution Service's failure to bring a charge of causing death by reckless driving; condemns the comments of Mr David Bennett in defence of the driver that the unborn child does not count; notes the comments of Mr Justice Naylor that if Ashley had been nine or ten days older then an actual life would have been lost; and calls on the Attorney General to urgently review this case and to reaffirm the value of unborn children's lives consistently protected by Common Law and to issue new guidelines to judges on the killing of unborn children.
